What is trademark?

A trademark is a sign that distinguishes the goods and services of one trader from those of others. Typically a trademark can be words (including personal names), indications, designs, letters, characters, numerals, figurative elements, colors, sounds, smells, the shape of the goods or their packaging or any combination of these. A sign must be capable of being represented graphically in order for it to be registered as a trademark.

A successful trademark can bring the trademark owner goodwill. This not only followed a huge profit, and also promotes trademark owner’s business. In order to protect your own intelligent right, register your trademark is a must.

Once a trademark application approved, the applicant will have the exclusive right for the trademark. If there is any tort against a register trademark, the trademark owner can take legal action to stop the tort and ask for indemnity. So the best protection method is to get trademark registered. Difference between Trademark Registration and Company Registrations

Separate laws and systems regulate the registration of company names, business names and trademarks in Hong Kong. A company name registration at the Companies Registry or a business name registration at the Business Registration Office (Inland Revenue Department) is not the same as a trademark registration at the Trade Marks Registry. A business or company name registration is not an indication of trademark rights. A Hong Kong business registration certificate or a company registration certificate does not by itself indicate that the business or company has rights to use its name or a trademark in promoting or dealing in goods and services.


How to register a trademark in Hong Kong

  1. Trademark search: Search for availability of the trademark including Chinese and English wording in the logo. According to you request, we will help them search if their logo is available to use.

  2. Making logo sample.

  3. In around 2-3 months after submitting the application, Trademark office will finish the trademark examination, a report will list out the examination result and limitation for the trademark.

  4. The trademark will then go through a public announcement process and it will take around 4 months time. If there is no objection for the trademark registration, the registration will be success. The trademark office will issue a certificate for the registration.


Documents required for trademark registration

  1. For corporate application please prepare Business Registration copy, for individual applicant please prepare ID/passport copy;

  2. Trademark sample, its size should be within 9cm x 9cm;

  3. A signed application (Can be signed by applicant or agency).


Registration Schedule

  1. Trademark search: 1 day

  2. Trademark Application: 6-9 months

  3. Registration certificate: 1 month after paying all the government fee after approval
